It usually takes a small coffee, or more than likely a few rounds of beer or any type of drink you can get your hands on, before it comes to kicking back after a tough day's work. Well, yeah I'm blameworthy about that one as well, unless I'm caught sporting a lampshade on my head following a few rounds of vodka virtually-naked! All right, bad example and I apologize to one and all checking this after suffering nightmares about me in that condition of a drunken haze.

Please don't ask how it happened, ok?

But what's very intriguing is that how do people go about the same part of living when faced by artery-popping pressure? I mean to say, the new age idea like Zen or Yoga is one of the better philosophies and it really does work. Is there space for the cerebral side of persons who can truly smell the roses-in-a-can whilst on the go? It kind of had me believing that there surely must be something in the 'mind-over-matter' idea.

Humor is certainly the best medicine there is wherever you are. I mean to say, anyone can pay top money to lend an ear to a clown, only to have you wet your knickers after chuckling so much. Mindful of what's been taking place, and to those who have suffered the nightmare, it's more beneficial to laugh and confront the troubles with a clear mind than rage with an unclear perception.

One of my favorite celebrities of all time may to be Woody Allen. Now Woody is one guy who gives you the in-your-face bluntness that he pulls out instinctively and with enthusiasm, apparantly not even appearing to try. You can chat about almost anything with a man, and he's guaranteed to make fun of the topic and you'll end up laughing as opposed to being than upset about it.

Whether we're churchgoing or not, it takes additional bravery to accept your fears and discover how to cope with them is all that matters when it comes to living together and getting along.

Early Vintage Computer Buses Have Their Influences On Your Computer Today

The term expansion bus is a frequent term in vintage computer terminology which requires elaboration. Much of the legacy of vintage bus systems are in our current computer systems today.

To begin with the expansion bus" is a data highway for computer data information to travel on: the bandwidth is in essence the number of lanes. The bigger the bandwidth the more data can be sent. The 486 line solidified and standardized the 32 bit systems in the established software of the day.

Backward compatibility at the time was a novel new concept which has remained an important consideration in the computer industry.

EISA slots would accommodate both the ISA and EISA expansion slots to allow hardware upgrades, However the EISA expansion boards would be of little advantage and would seldom work in the older ISA expansion slots.

On the other hand the Micro Channel setup was not backward compatible. On the one hand the Micro Channel developers were free to initiate new radical changes in computer development and hardware which would have allowed for major new useful features in computer software. However owners of previous systems would have been left with then obsolete vintage useless hardware which would have been of no use and certainly little financial value.

Hence there was a lot of resistance to the Micro Channel bus setup.

It died a lingering death with its legacy living on in the aspirations of features offered in future developments and standards.

Thus the die was set for future hardware standards and software function as well as standard computer marketing concepts that we take for granted like mothers milk today.

The Importance Of Self Motivation

Break your long term goals into short term goals and each day and night write a goal for the next day. If you focus on small steps you will eventually accomplish your goal.

Use bright post-it notes to write down all the positive things that will happen if you accomplish your goals. Stick them all over your home to remind you not to give up.

Eat well, exercise regularly and get a good nights sleep. These three will keep your body at optimum shape so you can focus on the days goals.

For each milestone make sure you have a reward. Take some time for your self. You can soak in the tub or take a nap or buy a new outfit, anything that will make you feel good about your accomplishments.

When bad days come along remember that there is always tomorrow. If your mood stays the same it might be a sign of depression. Issues such as depression can hamper your goals so make sure you check it out. When you reach your goals you will know yourself in a way you would never believed possible. Never quit no matter what because if you follow these tips and are successful you can do it all over again.

As a former military service member, you now plan to attend college at a four or two year institution. You are not quite sure of how to get started using your veterans benefits or how many years you have to utilize your VA benefits. Below are some documents needed by schools (VA Campus Service) from you or your dependents to receive funding to assist you in degree completion?

An application that is utilized for Chapters 30, 31, 35, 1606 and 1607. Chapter 30-for the veterans using benefits, Chapter 31-for veterans using vocational rehabilitation with a percentage of disability, Chapter 35-for dependents such as spouse, children and qualified adopted children, 1606 & 1607-for reservist using benefits.

For dependent usage of veterans benefits spouse should submit a copy of marriage certificate, qualified dependents should submit a copy of their birth certificate.

Veteran or dependents should declare a major of intent to the department in which they plan to matriculate in. This copy should also be submitted to the VA school official.

The veteran or dependents need to also submit a copy of their letter of acceptance from the Admissions Office to the certified veteran official for benefits.

Finally, if veterans or dependents have attended a university or college previously, these transcripts should also be submitted to the VA official. As a former member of the military you have ten years from the date of leaving the military to use your military benefits.

Once all these documents are submitted to your certified veterans official, new enrollees can began receiving benefits within sixty to ninety days.

Please keep in mind these documents maybe somewhat similar and different depending on the institution of choice. They are used as guidelines for submitting information in applying for VA Benefits only. Check with your school VA Officer for direct information.

The Truth About Exemptions on Interstate Use of Aircraft, Vehicles and Vessels

There is a tremendous amount of rumor swirling around the State of California since the regulations pertaining to vehicles, vessels and aircraft were drastically altered effective October 1, 2004. Some people now believe there are NO legal ways to obtain an exemption. Others still advise their friends that the old ninety day exemption still exists. Neither is correct.

Aero & Marine Tax Professionals (http://www.aeromarinetaxpros.com) are the pre-eminent experts in California sales and use tax involving aircraft, vehicles and vessels.

The following is true. I will use an aircraft in this newsletter as an example but the same applies to vehicles and vessels.

There used to be four methods of supporting a claim for an exemption. The first two were under a classification following the possession date.

This means that if you

1. take possession of an aircraft, vessel, or vehicle outside of the State of California,
2. make first functional use of that aircraft, vessel, or vehicle outside the state of California before it enters our state for the first time
3. and it remains outside the State of California for at least twelve months before it enters the state for the first time, it would be exempt from tax.

Although that may seem onerous enough, there is actually more to it.

1. You must be able to prove without a shadow of a doubt where the aircraft was located when the title transferred.

2. The definition of first functional use depends on what type of aircraft you purchase.

3. The burden of proof of providing documentation that supports the aircraft never landed inside California even once during the twelve months rests entirely on the taxpayer. For example: providing hangar receipts that the aircraft owner paid for a hangar in Medford, Oregon does not prove the aircraft was in the hangar.

4. The documentation will have to support that the aircraft was used and not just stored during the entire year. If there is a long period in the last part of the test period where the property is merely stored and not flown the auditor can attempt to throw out the storage time as storage for shipment to California. If the auditor is able to throw out the last six weeks of your test period and the aircraft enters California in the thirteenth month, it will be assessed tax.

Additionally, there are two separate ways the new regulation will be enforced. The type of enforcement depends on whether or not the taxpayer is a resident of California. The test period described above is for California residents. If the owner of the aircraft is a non-California resident, the test period is based on the aircraft being stored and used outside California for more than half of the first year.

Before a new aircraft buyer runs out to create an out-of-state LLC or corporation to be able to cut the requirement to six months, here is some additional data. If the Board of Equalization (Board) discovers the owners or shareholders of an out-of-state company are California residents, they can decide to apply the twelve month requirement. The taxpayer is not the one who gets to decide whether he or she is an out-of-state resident.

The following is intended to give you an idea of how the state determines that a company or person was a California resident. It all starts with wording from the regulation.

An aircraft purchased outside of California after October 1, 2004 and brought into California within 12 months of its purchase was acquired for storage, use, or other consumption in California and is subject to use tax if any of the following occur:

 The aircraft was purchased by a California resident (as defined in Section 516 of the CA Vehicle Code); or

 The aircraft was subject to property tax in California during the first 12 months of ownership; or

 The aircraft is used or stored in CA more than the time during the first 12 months of ownership.

"Resident" means any person who manifests an intent to live or be located in this state on more than a temporary or transient basis.

Presence in the state for six months or more in any 12-month period gives rise to a rebuttable presumption of residency.

The following are evidence of residency for purposes of vehicle registration:

(a) Address where registered to vote;
(b) Location of employment or place of business;
(c) Payment of resident tuition at a public institution of higher education;
(d) Attendance of dependents at a primary or secondary school;
(e) Filing a homeowner's property tax exemption;
(f) Renting or leasing a home for use as a residence;
(g) Declaration of residency to obtain a license or any other privilege or benefit not ordinarily extended to a nonresident;
(h) Possession of a California driver's license;
(i) Other acts, occurrences, or events that indicate presence in the state is more than temporary or transient.

I tell all my prospective clients, It does not matter that you are a resident of Ohio, take possession of your aircraft in Florida and register it in a Delaware Corporation. If the aircraft enters the State of California any time within the first twelve months, the state has the right to assess the tax on your purchase and you have the burden of proof to support a claim for an exemption. If the Board contacts you and you ignore them because you think you are an out-of-state resident, the Board will ultimately lien your aircraft or worse - raid your bank account.

THERE IS GOOD NEWS

The good news is that there still exists an exemption that allows you to bring your aircraft into the State of California and it can be stored inside California and still support a claim for an exemption. It is known as the commercial interstate flight hours test.

The restrictions that apply to the principal use test do not apply to the commercial interstate flight hours test (such as California ownership, property taxes, etc.). There are three things you must do and they must be done in the following order:

1. The purchaser must be able to document that he took title to the aircraft outside the State of California.

2. The property must be first functionally used outside the state of California before it enters California the first time after the out of state possession occurs. (As was explained above, this depends on the type of aircraft.) Typically for this form of exemption an interstate flight for a business purpose with passenger on board who is not part of the flight crew is required.

3. It must be flown in interstate commerce for more than half of the flight hours accumulated after the date of first entry into California. Our firm raises the standard to 60%.

This means that if the purchaser has any business that requires him to fly outside the State of California he is eligible to consider this form of exemption.

The test period is based on flight hours only and does not include the flight hours prior to entering California the first time. The flight hours commencing from the out of state possession point to the new destination for a business purpose, then on into California, are not part of the test period but are required in order to get into the test period.

For example, we will create a scenario to explain how it works: Dan Jones is in the manufacturing business and it is located inside California. He purchases a new Citation aircraft and takes possession in Kansas. Mr. Jones is a passenger on the jet and his two pilots fly him from Wichita to Denver, Colorado, to meet with a client who buys bolts from Mr. Jones manufacturing company. After the meeting in Denver, Mr. Jones is flown to Van Nuys, California aboard his new Citation.

The above steps are examples of out-of-state possession, first functional use, and date of first entry into California. The test period has been properly started, but no hours are calculated yet. Those hours start with the first flight after the date of first entry.

If the aircraft enters the state on March 15, 2005 the test period will end six months later on September 14, 2005. If the aircraft is flown 100 hours during the six months, the regulation requires at least half of the total hours are flown in interstate commerce. Our firm always insists on at least 60% to create a margin of error.

Obviously this means that 40% of the hours can be a combination of personal or intrastate use. What may be less obvious is exactly how to figure which hours are on the good side of the test and which are on the bad side.

Definition of Commercial

The flight hours must be for a business purpose. They can be 100% Part 91 hours or a combination of Part 91 and Part 135.

Definition of intrastate vs. interstate

One needs a basic understanding of the definition of interstate and intrastate to start with. An interstate flight is one which commences in one state (or country) and ends in another. For example, flying from Van Nuys, California to Las Vegas, Nevada is an interstate flight. A flight from Van Nuys to Cabo San Lucas, Baja, Mexico also qualifies as an interstate flight.

An intrastate flight is one which commences and terminates in the same state. An example of an intrastate flight would be a flight from Van Nuys to San Francisco. Similarly a flight from Reno, Nevada to Las Vegas, Nevada, is an intrastate flight. For the purpose of this test period, all intrastate flights count on the bad side of the test.

What may not be so obvious is there are three types of flights - not just two. All intrastate flights count on the bad side. All interstate flights for a business purposes count on the good side. Those are the easy ones to understand. However, there exists a third type and they all fall on the bad side of the test. Any interstate flight that is not supported with documents that establish a business purpose for the flight counts on the bad side. An example would be a flight from Van Nuys, California to Aspen, Colorado, for skiing. Additionally, an interstate flight where the taxpayer fails to provide documentation to support the business purpose also moves those flight hours to the bad side.

How to calculate flight hours

Flight hours are not calculated by airspace. For example, during the old principal use test if an aircraft flew from San Diego to Medford, Oregon and the flight took three hours, two hours and forty-five minutes were calculated as being in the air space of California and fifteen minutes was considered to be out of state. When the aircraft is supporting a claim for an exemption using the commercial interstate flight hours test, the same three hour flight from San Diego to Medford counts on the good side of the test. This would also include the three hour return part of the round trip. As long as the aircraft owner can provide documentation from a third party that affirms there was a business reason for his flight to Medford, all the flight time counts an as interstate flight for a business purpose.

The basic difference between the principal use test and the commercial interstate flight hours test.

The principal use test is based primarily on location and storage. It matters little where an aircraft is flown during the new principal use test as long as the flights occur outside of California. Obviously, in order to complete a twelve month test, it is based on time. During that time the taxpayer must primarily prove where the aircraft was located every one of the 365 days. Aircraft spend most of their lives on the ground. Therefore, storage documentation becomes very important. The taxpayer must prove where the aircraft is located every minute it is on the ground as well as in the air.

The commercial interstate flight hours test is based solely on the total flight hours during the six-month test period. Therefore, this test is based primarily on flight hours where the principal use test is based primarily on storage.

One of the perks of the commercial interstate flight hours test is that the aircraft could be hangared inside California every night of the test period at the airport closest to the owners home and still be exempt from tax. For example: Returning to Dan Jones and his new Citation purchase. Presuming that Mr. Jones arrived at Van Nuys on March 15, 2005 (beginning of the six-month test period) the test period will end on September 14, 2005. During that time, Mr. Jones traveled exclusively between the home office of his company and the regional office in Seattle, Washington. He leaves Van Nuys every Monday morning and returns on Monday evening to Van Nuys. For the purpose of this example, no other flights are made, other than the weekly flights to Seattle. This would mean 100% of the flight hours were for a business purpose. (This exceeds our 60% requirement.) It also means the aircraft was on the ground at Van Nuys every night of the test period during the entire six months.!

With proper documentation, this aircraft will support a claim for an exemption.

If one were to look at the same use of this aircraft from the point of view of the principal use test which is based primarily on storage it would be taxable. Therefore, if you can support business use of an aircraft this test is perfect for you.

Bleeding Green and Gold

I started following Major League Baseball at the age of 10, shortly after the A's moved from Kansas City to Oakland in 1968, and it didnt take me very long at all to figure out that baseball was, at least for me, the greatest sport in the history of the universe (nothing else has ever come close).

I regularly begged my parents to take me to A's games as a youngster, but it never happened often enough for my liking (Oakland was a long, arduous 90 minute drive away from our home in the central valley).

Nonetheless, I always treasured every moment of the games I did attend.

I quickly became attached to the A's in a big way, and followed their every move as if my own life hung in the balance. I remember being absolutely crushed when they were swept by the Baltimore Orioles in the first and (at the time) only round of playoffs in 1971... and then thrilled beyond my wildest imagination only a year later.

In those early years I watched the A's change from a team of mediocrity to one of greatness. Since then, I have seen them morph a number of times from awful to brilliant and back again. Of course I still feel disappointment when they fail to clinch a playoff berth, or lose a series in the post season (as they just finished doing), but tend to get over it much more quickly than I did as a kid.

When I moved abroad in 1981, and in the many years away from home that followed (nearly 25), I discovered that my passion for baseball and the A's did not diminish at all... if anything, it may have grown even stronger.

I still tried to attend games when making trips home to visit friends and family. In fact, I made a point of scheduling several vacations near the end of the season so I'd be able to watch the pennant races wind down, and then catch the first round of playoffs (by the way, after moving back to northern California last year, I find that a 90 minute drive to Oakland takes absolutely no time at all!)

Through the years I have been fortunate enough to attend a few post-season games, though never during a World Series (wasn't persuasive enough to talk my parents into that). And although I have never been there to see them clinch any sort of championship in person (not that they didnt have the opportunity), I do have a handful of special baseball memories to look back on.

In addition to all the great players and games I've seen at the Coliseum, I was also lucky enough to witness George Hendrick's first career home run (a walkoff with 2 outs in the 10th inning), Sal Bando's grand slam on the 4th of July, watched Bert Campinaris fling his bat over the head of Tigers pitcher Lerrin LaGrow after being hit by a pitch in game two of the '72 Division Series and, on the final day of the regular season in 1975, saw the quartet of Vida Blue, Glenn Abbott, Paul Lindblad and Rollie Fingers combine on a no-hitter to beat the Angels (I was also there to see Jeter's miracle-flip to Posada in game three of the 2001 Division Series, but as an A's fan its awfully hard to rate that as a highlight).

My allegiance to the A's has certainly been tested a time or two in my nearly 40 year career as a fan, most notably when former owner Charles O. Finley saw many of my favorite players heading for the exits in the mid-seventies, and courteously stood there holding the door open for them (heck, he even gave a couple of them a nudge). I threatened to start following another club at the time, but could never actually bring myself to do it.

The Oakland A's have always been my one and only team, and the fact that they always will be should come as a surprise to no one.

Your Choice of Focus Makes a Big Difference in Accomplishing 20 Times as Much

Many people choose what to work on solely based on their enthusiasm for the subject. For example, salespeople may feel more energized by redesigning the compensation system than they do by finding more leads. Why? The compensation system shift can increase their pay from the current effort. There's no necessary connection between finding more leads and any personal benefit. But in an organization that has too few leads, finding lots of good leads could create more compensation gains than changing the compensation system. You have to watch out for what will help you achieve the most at an individual level before picking a 2,000 percent solution focus.

The same problem applies to entire organizations. Leaders need to fully consider potential benefits before selecting a focus as well. Let's consider an example of how the choice of creating a 2,000 percent solution can make a large positive or negative difference for an organization. In Apple Computer's early days, the organization set its focus on having a superior operating system and user features that would make it very appealing to do advanced computing on an Apple Macintosh. For many years after the IBM PC standard was set, users consistently reported preferences for Apple's offerings. The only aspect where the PC standard did well compared to Apple was in having more application software available for PCs. Microsoft was a much smaller company at the same time, and also had an objective of providing a superior operating system for personal computers. Microsoft focused its attention on improving its software and the frequency of upgrades in creating its 2,000 percent solutions for its computer users. Apple continued to work on all aspects of computing that affected its hardware or software. If Apple instead had selected the Microsoft focus, Apple could have chosen to make its proprietary operating system work on the PC standard as well. Microsoft would have continued to do well on IBM-built personal computers, but Apple could have gained leadership with most of the clone PC makers who soon dominated the market. If successful in that focus, Apple would now be the world's most valuable company and would probably have stopped providing its own computing hardware.

As you can see from this example, it's important for organizations to think about the benefits that current customers and stakeholders receive. But it's even more important to think about the benefits that potential stakeholders will obtain as well. In addition, how will your change affect the competitive balance in the market place? Can you, like Apple might have, cut off a powerful future competitor by concentrating your focus where it will do you the most good?

An aircraft purchased outside of California after October 1, 2004 and brought into California within 12 months of its purchase was acquired for storage, use, or other consumption in California and is subject to use tax if any of the following occur:

 The aircraft was purchased by a California resident (as defined in Section 516 of the CA Vehicle Code); or

 The aircraft was subject to property tax in California during the first 12 months of ownership; or

 The aircraft is used or stored in CA more than the time during the first 12 months of ownership.

"Resident" means any person who manifests an intent to live or be located in this state on more than a temporary or transient basis.

Presence in the state for six months or more in any 12-month period gives rise to a rebuttable presumption of residency.

The following are evidence of residency for purposes of vehicle registration:

(a) Address where registered to vote;
(b) Location of employment or place of business;
(c) Payment of resident tuition at a public institution of higher education;
(d) Attendance of dependents at a primary or secondary school;
(e) Filing a homeowner's property tax exemption;
(f) Renting or leasing a home for use as a residence;
(g) Declaration of residency to obtain a license or any other privilege or benefit not ordinarily extended to a nonresident;
(h) Possession of a California driver's license;
(i) Other acts, occurrences, or events that indicate presence in the state is more than temporary or transient.

I tell all my prospective clients, It does not matter that you are a resident of Ohio, take possession of your aircraft in Florida and register it in a Delaware Corporation. If the aircraft enters the State of California any time within the first twelve months, the state has the right to assess the tax on your purchase and you have the burden of proof to support a claim for an exemption. If the Board contacts you and you ignore them because you think you are an out-of-state resident, the Board will ultimately lien your aircraft or worse - raid your bank account.

THERE IS GOOD NEWS

The good news is that there still exists an exemption that allows you to bring your aircraft into the State of California and it can be stored inside California and still support a claim for an exemption. It is known as the commercial interstate flight hours test.

The restrictions that apply to the principal use test do not apply to the commercial interstate flight hours test (such as California ownership, property taxes, etc.). There are three things you must do and they must be done in the following order:

1. The purchaser must be able to document that he took title to the aircraft outside the State of California.

2. The property must be first functionally used outside the state of California before it enters California the first time after the out of state possession occurs. (As was explained above, this depends on the type of aircraft.) Typically for this form of exemption an interstate flight for a business purpose with passenger on board who is not part of the flight crew is required.

3. It must be flown in interstate commerce for more than half of the flight hours accumulated after the date of first entry into California. Our firm raises the standard to 60%.

This means that if the purchaser has any business that requires him to fly outside the State of California he is eligible to consider this form of exemption.

The test period is based on flight hours only and does not include the flight hours prior to entering California the first time. The flight hours commencing from the out of state possession point to the new destination for a business purpose, then on into California, are not part of the test period but are required in order to get into the test period.

For example, we will create a scenario to explain how it works: Dan Jones is in the manufacturing business and it is located inside California. He purchases a new Citation aircraft and takes possession in Kansas. Mr. Jones is a passenger on the jet and his two pilots fly him from Wichita to Denver, Colorado, to meet with a client who buys bolts from Mr. Jones manufacturing company. After the meeting in Denver, Mr. Jones is flown to Van Nuys, California aboard his new Citation.

The above steps are examples of out-of-state possession, first functional use, and date of first entry into California. The test period has been properly started, but no hours are calculated yet. Those hours start with the first flight after the date of first entry.

If the aircraft enters the state on March 15, 2005 the test period will end six months later on September 14, 2005. If the aircraft is flown 100 hours during the six months, the regulation requires at least half of the total hours are flown in interstate commerce. Our firm always insists on at least 60% to create a margin of error.

Obviously this means that 40% of the hours can be a combination of personal or intrastate use. What may be less obvious is exactly how to figure which hours are on the good side of the test and which are on the bad side.

Definition of Commercial

The flight hours must be for a business purpose. They can be 100% Part 91 hours or a combination of Part 91 and Part 135.

Definition of intrastate vs. interstate

One needs a basic understanding of the definition of interstate and intrastate to start with. An interstate flight is one which commences in one state (or country) and ends in another. For example, flying from Van Nuys, California to Las Vegas, Nevada is an interstate flight. A flight from Van Nuys to Cabo San Lucas, Baja, Mexico also qualifies as an interstate flight.

An intrastate flight is one which commences and terminates in the same state. An example of an intrastate flight would be a flight from Van Nuys to San Francisco. Similarly a flight from Reno, Nevada to Las Vegas, Nevada, is an intrastate flight. For the purpose of this test period, all intrastate flights count on the bad side of the test.

What may not be so obvious is there are three types of flights - not just two. All intrastate flights count on the bad side. All interstate flights for a business purposes count on the good side. Those are the easy ones to understand. However, there exists a third type and they all fall on the bad side of the test. Any interstate flight that is not supported with documents that establish a business purpose for the flight counts on the bad side. An example would be a flight from Van Nuys, California to Aspen, Colorado, for skiing. Additionally, an interstate flight where the taxpayer fails to provide documentation to support the business purpose also moves those flight hours to the bad side.

How to calculate flight hours

Flight hours are not calculated by airspace. For example, during the old principal use test if an aircraft flew from San Diego to Medford, Oregon and the flight took three hours, two hours and forty-five minutes were calculated as being in the air space of California and fifteen minutes was considered to be out of state. When the aircraft is supporting a claim for an exemption using the commercial interstate flight hours test, the same three hour flight from San Diego to Medford counts on the good side of the test. This would also include the three hour return part of the round trip. As long as the aircraft owner can provide documentation from a third party that affirms there was a business reason for his flight to Medford, all the flight time counts an as interstate flight for a business purpose.

The basic difference between the principal use test and the commercial interstate flight hours test.

The principal use test is based primarily on location and storage. It matters little where an aircraft is flown during the new principal use test as long as the flights occur outside of California. Obviously, in order to complete a twelve month test, it is based on time. During that time the taxpayer must primarily prove where the aircraft was located every one of the 365 days. Aircraft spend most of their lives on the ground. Therefore, storage documentation becomes very important. The taxpayer must prove where the aircraft is located every minute it is on the ground as well as in the air.

The commercial interstate flight hours test is based solely on the total flight hours during the six-month test period. Therefore, this test is based primarily on flight hours where the principal use test is based primarily on storage.

One of the perks of the commercial interstate flight hours test is that the aircraft could be hangared inside California every night of the test period at the airport closest to the owners home and still be exempt from tax. For example: Returning to Dan Jones and his new Citation purchase. Presuming that Mr. Jones arrived at Van Nuys on March 15, 2005 (beginning of the six-month test period) the test period will end on September 14, 2005. During that time, Mr. Jones traveled exclusively between the home office of his company and the regional office in Seattle, Washington. He leaves Van Nuys every Monday morning and returns on Monday evening to Van Nuys. For the purpose of this example, no other flights are made, other than the weekly flights to Seattle. This would mean 100% of the flight hours were for a business purpose. (This exceeds our 60% requirement.) It also means the aircraft was on the ground at Van Nuys every night of the test period during the entire six months.!

With proper documentation, this aircraft will support a claim for an exemption.

If one were to look at the same use of this aircraft from the point of view of the principal use test which is based primarily on storage it would be taxable. Therefore, if you can support business use of an aircraft this test is perfect for you.

A Custom Google Search on your own Site is a Powerful Tool

As your website grows you need a tool to make it easier for your readers to search for information on the site.

A great solution for installing a search function on your site is available through Google. Google offers the ability to download a Google search box to your website to search the contents of the site. The results will be presented in the same format as the Google search engine results page.

Google offers two options for the search function.

If you go to Google Free at http://www.google.com/services/free.html you can register to get the HTML code that will put the Google search on your site. This requires that you fill in information that is requested and the site will be customized for you. You can then preview the results, and if it is what you want, you copy the HTML code that Google gives to you and paste it into your web page where you want the search box to appear. It is fairly easy to do.

If you have a logo, you can insert it in the input information and the logo will appear on the search engine results pages. Click the following link to see the Boomer eZine example http://www.boomer-ezine.com/Boomer_eZine_Search.htm. Once the search page loads, enter SBI in the search box and search. The results will be all of the times SBI appears on the Boomer eZine site. Notice the Boomer logo on the customized search engine results page.

The look of this results page is attractive, but you have no control over the Adwords adds that are placed on the right side of the page with the results of the search. Ads for your competitor will appear on the results page and this may be unacceptable to you.

The other option is to use Google Adsense for Search. This allows you to create a customized Google search for your website. This option has filters that you can set to exclude certain websites from being included in the Adsense ads on your site. The other benefit is if someone clicks on an Adsense ad, and purchases an item, you get a fee for the transaction.

When you log on the Google Adsense site, you can choose to use Google Web search or Google Web search + Site Search. Select the Google Web search + Site Search.

On the page where you specify the options for the search function, enter the URL for your site and the other required information. You will be given the chance to review what it will look like and you can change parameters until you are satisfied.

At the bottom of the page, there are three options for how the search results are displayed.

Open results on Google in the same window Open results on Google in a new window Open results within your own site

The last option is probably the best for you. This will place the search results on a page in your site with your own header and footer. It holds the reader on your site. Option one keeps them on your site, but they do not get that impression since all they see is a Google page. Option two opens a new window and sends them to Google. You might lose them at that point.

Option three requires that you specify a web page for the search results, but that is easy if you specify the same page the search box is on. If you put the search input box and the search results below the search box, your page will function like Google.

On the next Adsense page you specify the color scheme for your ads, the country for the search, if you want to use Safe Search (keeps porn from coming up on the web search), and if you want to use a tracking channel. I recommend that you use channels for each different use of Adsense so you can see where your revenue is coming from.

On the next Adsense page, you will get two sets of HTML code. One set goes on the page at the location where you want the search box. The other code goes on the location on the page where the search results will be placed. Copy the HTML from the Google site and paste it into the proper location on your web page. View your page and see how it looks. The search box may be left justified and you may want it in the center of the page. If so, use the HTML center tags to center the search box and the frame on the page. ( Center tags are and the closing center tag is . After you have pasted the code into your page, insert the center tags just before and just after the beginning and ending Google comments.

The code for the search results location begins and ends with and ends with . Put the center tags before and after these comments.

Upload your page to your site and put it to work for you. To see an example of the final results for a Google Adsense for search installation, go to the Boomer eZine website (see link below) and click Site Search on the navigation bar on the left. This will take you to the search page. Enter SBI as the search term and click the search button. The results will be displayed under the search box along with the Adsense ads at the top and bottom of the search results.

This is a handy tool to install on your site. It enhances your website. It does not cost anything and you can make money with it if someone clicks on an Adsense ad on the search results page. A real win, win deal!

Small Stuff And The Power Of A Penny

This is the second time this has happened. Once with a neighbor and again this past week at our rental property. A penny, a simple little penny disrupted a household by lodging itself between the wall and the spinning plate inside a garbage disposal. When it happens, this little penny can stop the workings of a kitchen in an instant.

Think about the stuck penny for a minute. When one flicks the disposals switch, nothing happens. Not even a match for a fork attack or a torrent of water.

Large chunks of food sit idle. Decay. Inevitably, stench. Plus more problems.

Dishwashers are often connected to disposals as a primary or secondary crusher, so when the dishwasher starts to pump out its water, the sink starts to fill up. Fork and water attacks are followed by the plunger. Still, nothing works.

From this point on, you might say the kitchen surrenders control to a simple, out-of-place penny. If theres only one sink, one can't clean dishes at all.

The residents time, once used for productive activity or relaxation, is now spent working around a dysfunctional sink.

Then come repairs. If the owner calls a plumber, he will pay for repairs or installation of a new unit. A do-it-yourself job will likely result in a helter-skelter mess under the sink, a combination of dismantled pipes and the water thats seeped out of them.

Well, that penny is like your business decisions or actions. One small decision or one small action can completely alter outcomes, even grind operations to a standstill, if youre not careful.

With only a few weeks left until the year ends, you can still make seemingly small decisions or take small actions that will have a huge impact on your organization in the upcoming year.

Here are a few:

Upgrade: Outdated technology, old equipment and software slow you down and prevent you from competing at your best. You dont always have to have the newest state-of-the art items, but you cant afford to miss deadlines or turn out shoddy products, because your equipment isnt keeping pace. We recently revisited an old vendor to buy some marketing products. One employee explained how the owner almost went out of business a few years ago and complained that times were tough even now. A quick glance around the production shop told the story. Equipment was archaic at best. The vendor couldnt produce even the simplest of products for us by todays standards. She struggled her way through the job, losing our confidence. Because she couldnt output what she claimed, she had to compensate with products that we didnt originally want. She also put undue pressure on us as she blew our deadline. We wont be returningnor, we suspect, will many of her other customers.

Buy: Purchase reliable, portable tools to keep yourself organized. PDAs, phones with calendars and internet access allow you to stay on top of things even when youre away from your desk. We use the Treo products offered by most of the major players. (RIM the provider of the Blackberry currently has a $400 million to $1 billion patent suit that may affect several million subscribers, so step cautiously with this product for now.) Say youre at an event and you have the good fortune of meeting a very lucrative prospect. Youre busy, hes busy, and the timing is just right to make a follow-up appointment to talk serious business. Your chances of making that appointment happen, of closing a sale, and of building a long-term business relationship greatly increase if you can strike while the iron is hot. Having your calendar in your pocket via one of these handy devices affords you the ability to seize opportunity now, rather than having to wait until you return to the office and have to navigate your way past the prospects gatekeeper on the phone.

Strategize: Visit your strategic plan and make adjustments. Our philosophy is that if management does not have their strategic plan on their desk regularly the plan is most likely useless. Think of it this way. When you travel you have your map or GPS with you and refer to it often. This means it must be in a form that key decision makers can use to plan their day every day for the upcoming year. David just worked with Infosys, a company made famous by its own merits and highlighted in Thomas Friedmans most recent book The World is Flat. During a strategizing session with members of the board and billionaire CEO Nandan Nilekani, the management often stated they've had 49 consecutive quarters of profitable growth hitting both revenue and profit projections while growing close to 45% per year. Sanjay, the Chief Strategist, spends his days making sure their strategy is on target. They expect to grow from $2.2 billion to over $3 billion next year. This from a group of people who each put $250 into starting the business. When they were all done, David and the team were able to put the strategy onto one page so that everyone was in sync. In addition, the plan has to meet its purpose, but its length neednt rival War and Peace. The most important thing to remember here is that you have to use the strategic plan as your road map to success in the upcoming year. Getting it down on paper is often the most challenging task, but by far, the rewards outweigh the time and effort you initially expend up front.

Learn: Promise to put self-education somewhere on your list of goals this year. Assess the ways you currently feed new information into your brain. What means give you the biggest brain boost for the time and cost? Replace those that dont cut it any more. The good news is that there is a plethora of great books out there targeted to hungry leaders who want to do better this year than last. If you belong to a networking group or other professional club, ask around to see what others are reading that might be of benefit to you. Magazines are good for gaining awareness, but by nature (the lengths of articles are short), they cant compete with books in terms of providing depth and enough information to allow you to retain and utilize what youve learned as well. There are also some excellent programs for executives offered through continuing education departments at universities such as from online programs to classroom settings. The courses that David teaches at New York University are experiences in and of themselves. Business 2.0 also recommends University of Virginia, University of Chicago, and others (see their website) to appeal to those in various geographic areas.

Balance: Schedule time to live your life amidst a busy work regimen. This can be tough for those at the management and ownership levels. Whats the point of anything you do if your nose is so close to the grindstone that you dont see any fun in your life? Working long and hard is admirable and often yields great successes. But theres no guarantee that numerous hours of sacrifice will bring a proportional load of prosperity. In fact, workaholic martyrs find themselves spinning their wheels, because they dont have the mental breaks they need to rejuvenate themselves and bring fresh thinking to the table. The time you take doesnt have to be on a long trip far away. You can start by taking a 3-day weekend or a Wednesday afternoon just to clear your head. If travel is something youd like to do, try going somewhere that would benefit your business: visit a vendor, attend a conference, tour a clients operations, study your craft at a course. Youll be able to justify the time and expense to yourself and get away at the same time.

Exercise: This is not a New Years resolution that you can let slide by the time February rolls around. And no, were not stressing the importance of activity, because it will make you look prettier. Stress combined with a sedentary lifestyle will eventually take its toll on your heart or surprise you with other health calamities, if you dont take care of yourself. Exercise is NOT optional, it is as important as nutritious food and fresh air. Just 20 minutes of activity 4 times a week can greatly improve your health. If youre looking for an easy, proven formula that combines activity with eating healthfully, pick up a copy of Bill Phillips book, Body for Life. Youll be inspired as well as informed. Besides improving the quality and length of your life, youll improve blood flow to your brain, allowing you to make faster and better decisions on the job.

Spend: If you havent already, take an overall picture of your organization and determine where extra dollars can go to make improvements. Is there an unreliable computer in the mix or a crackly phone that deserves a slam dunk in the trash bin, nows the time to make changes. Not that we have anything against the tax man, but lets face it, some wise spending now will improve your tax burden as well as your operations. Just be sure to get purchases documented by the end of your fiscal year, whether thats December 31 or another date. We know, December is a month when youre distracted by holiday parties and the prospect of a few well-deserved days off with the family. Just make sure to keep the distractions in check and stick to the deadline. Also, if youre not sure where to wisely place those extra dollars, call in trusted colleagues or other outside advice. When it comes to your own work environment sometimes its difficult to make an unbiased judgment call. Someone from the outside often can see your challenges because they are not stuck in your day to day work routine.

Deplete: For those of you with mandated or restricted budgets, you may have to spend a certain amount to maintain budget figures for the following yearthe old use it or lose it philosophy applied to budgets. This doesnt always make a lot of sense to the rest of the world, but if you cant avoid the process, there are some strategies you can deploy to stretch the benefits of in-a-rush spending. Your smartest options are to look at opportunities that require payment now but that can either be utilized or delivered at intermittent times throughout the upcoming year: conferences, training and development programs, services or products that arrive on a monthly or rotating basis, etc. Besides, projects paid for in advance dont get cut that easily. New projects are subject to the new years scrutiny.

Not sure how to choose what tactics to employ? How about placing a numerical figure next to each one on a scale of 1-5 with 1 being the hardest to do and 5 being the easiest? Then rate the return on your efforts with 1 being the lowest return and 5 being the highest. Add the numbers together. Those with the highest number are obviously your top choices.

As you can see, even with only a few weeks left to the year, there are still options available to you to make rapid change to your organization. Adding just one of these tactics to your tool kit this month could transform the way you do business next year.
